What are the fines for discriminations against people with disabilities in Vietnam?

What are the fines for discrimination against the disabled in Vietnam? What are prohibited acts against the disabled in Vietnam?  One day, I was on a bus to school. There was a disabled person using a wheelchair on that bus, so it was quite cramped. During the trip, there was a person who constantly nagged and scolded that disabled person. Shall that act be fined according to the Law? What are prohibited acts against the disabled in Vietnam? 

What are the fines for discrimination against the disabled in Vietnam?

Pursuant to Article 11 of the Decree 130/2021/ND-CP stipulating violations of regulations on prohibited acts against persons with disabilities in Vietnam as follows: 

1. A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed when:

a) Discriminating persons with disabilities;

b) Obstructing the legal right to get married or adopt children of persons with disabilities;

c) Obstructing independence and social integration of persons with disabilities;

d) Obstructing participation of persons with disabilities in social activities;

dd) Obstructing access of persons with disabilities to information technology.

2. A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed on failure to care, nurture persons with disabilities as per the law.

3. A fine ranging from VND 10.000.000 to VND 20.000.000 shall be imposed on exploit of images, personal information, or conditions of persons with disabilities or organizations of persons with disabilities or organizations for persons with disabilities for personal gain or violation of the laws.

4. A fine ranging from VND 30.000.000 to VND 40.000.000 shall be imposed on inducing, talking, or coercing persons with disabilities to commit violations in a manner that is not liable to criminal prosecutions.

5. Remedial measures:

Mandatory return of money illegally generated by the violations under Clause 2 and Clause 3 of this Article.

In the case you mentioned, the person, who discriminated against a disabled person, shall be fined from VND 3.000.000 to VND 5.000.000.

What are prohibited acts against the disabled in Vietnam? 

Pursuant to Article 14 of the Law on Persons with Disabilities in 2010 stipulating prohibited acts in Vietnam as follows: 

1. Showing stigma or discrimination against persons with disabilities.

2. Infringing upon physical body, dignity, honor, property or legitimate rights and interests of persons with disabilities.

3. Enticing or forcing persons with disabilities to violate laws or social ethics.

4. Abusing persons with disabilities, organi­zations of persons with disabilities, organizations for persons with disabilities, images, personal information and status of persons with disabilities for personal profits or commission of violations.

5. Failing to perform or to fulfill the responsibility to nurture and take care of persons with disabilities by persons who have the responsibility to nurture and take care of persons with disabilities.

6. Obstructing the right of persons with disabilities to marriage or child adoption.

7. Being dishonest in determining the degrees of disability or granting disability certificates.

As regulations above, the act of discriminating the disabled on the bus is a violation against the Law.
